When a Buyer completes a purchase without creating an account (guest check-out), the Agreement becomes effective and binding upon sale completion.

Members

By utilising the Site, you agree to the following terms:

3D Printing Models Usage Terms

Applicability

Upon purchasing a Product on the Site, the Seller and Buyer agree to the terms outlined herein.

These terms are supplementary to the General Terms and will be applied in conjunction.

Rights, Duties, and Declarations of the Seller

The Seller must upload only content they possess or have proper authorization to use and upload.

By uploading a Product, the Seller affirms that it and its use, as per the General Terms, do not violate the intellectual property rights of any other entity. Additionally, the Seller confirms that they have obtained all required model or property releases for the Product’s use and licensing.

The Seller may seek legal advice to determine the necessity of a specific model or property release form for uploading a particular Product or its particular use. Failure to provide a required release with an uploaded Product may adversely affect its licensing.

The Seller is responsible for maintaining backups of their uploaded Products. Uploaded files cannot serve as backup sources.

The Seller maintains ownership of copyrights and all other rights in the Product uploaded to the Site.

Upon uploading a Product to the Site, the Seller warrants that:

• The Product is their original creation and does not incorporate copyrighted material they do not exclusively own.
• They have the authority to enter and fulfil this Agreement and have secured all necessary third-party consents.
• The Product does not infringe on any third party’s intellectual property or other rights.
• The Product complies with all laws, statutes, ordinances, or regulations.
• The Product is not defamatory, libellous, pornographic, obscene, or inciting racial hatred.
• The Product does not contain viruses or other programming routines that interfere with computer systems or data.
• The Product does not impose additional licence restrictions, such as publishing source code or limiting the commercial exploitation of the Incorporated Product.
• All factual statements made are accurate and complete. The Seller agrees to provide necessary documentation to the Buyer to evidence or enforce their rights under this Agreement.

Rights, Duties, and Declarations of the Buyer

The Buyer may only use the Product downloaded from this Site in a manner that respects the intellectual property rights of other parties. Reverse engineering of any Product is strictly prohibited, and the Buyer must adhere to the terms of the licence granted to them under these General Terms and any additional Seller terms included with the Product.

The Buyer shall refrain from employing automated mass downloading (crawling) techniques to access Products offered as free downloads. Moreover, Products offered as free downloads shall not be utilised for machine learning or neural network training purposes.

Upon paying any applicable licence fee for a Product, the Buyer may download the Product from the Site and use it according to the relevant licence terms. The Buyer is responsible for ensuring that their use of the Product complies with all applicable laws and regulations and does not infringe upon the rights of third parties, including intellectual property rights.

Before concluding the contract, the Buyer shall explicitly waive their 14-day right of withdrawal concerning digital content (the Product).

In cases where the Buyer intends to order and buy products in bulk, Ixonar may assist the Buyer in manually completing the purchase process at the Site to effect the sale of Products (e.g., adding Products to the shopping cart in bulk).
